affirmative defense

affirmative defense /əfur″mətiv/ [L, affirmare, to make firm] , (in civil law) a denial of guilt or wrongdoing by a health care provider in a civil action, in which one asserts that one adhered to the local standards of care. The defendant bears the burden of proof in an affirmative defense.
